Overview of Vietnam Trademark Registration
The Vietnam Intellectual Property Office (NOIP) is responsible for trademark registration management. The registered trademark is valid for 10 years from the application date and can be renewed indefinitely. After registration, it is fully protected under the "Vietnam Intellectual Property Law".
Legal Protection
After successful registration, exclusive rights are obtained throughout Vietnam, allowing for legal actions against infringement, including trademark infringements on e-commerce platforms (Shopee, Lazada Vietnam).
Registration Period
Under smooth circumstances, the entire registration process takes about 8-12 months, including key stages such as formal examination, substantive examination, publication, and approval. The scrutiny level is higher than in some Southeast Asian countries.
International Integration
Vietnam is a member of the Madrid System, allowing for international trademark protection through the Madrid Protocol, covering the Vietnamese market without the need to submit a separate application to NOIP.
Trademark Registration Process
Vietnamese trademark registration follows the "Vietnam Intellectual Property Law" and NOIP examination rules. The standardized application steps are as follows:
1. Trademark Search
Search the NOIP database to assess the registrability of the trademark, avoid conflicts with prior trademarks, and reduce the risk of rejection. Vietnam uses the 11th edition of the Nice Classification.
2. Submit Application
Prepare complete application materials, submit the registration application to NOIP, and pay official fees. The application receipt and application number are issued within 3-5 working days.
3. Formal Examination
NOIP examines the completeness and compliance of the application documents. Non-compliant documents must be corrected within a specified period, generally 3 months.
4. Substantive Examination
Examine the distinctiveness and legality of the trademark, and whether it is similar to prior trademarks. The examination cycle is about 4-6 months.
5. Publication and Opposition
Trademarks are published in the Vietnam Official Trademark Gazette for 2 months. Any interested party can file an opposition during this period. If there is no opposition, the registration is approved.
6. Certificate Issuance
After completing all examination procedures, NOIP issues the trademark registration certificate, making the trademark officially effective, with a validity of 10 years.
