Overview of Indonesia Trademark Registration

The Directorate General of Intellectual Property (DGIP) of Indonesia is responsible for trademark registration management. The validity period of a registered trademark is 10 years, calculated from the date of application, and can be renewed indefinitely. Once registered, it is fully protected under the "Indonesian Trademark Law 2016".

🛡️

Legal Protection

After successful registration, exclusive rights are obtained throughout Indonesia, allowing legal stopping of infringement, including trademark violations on e-commerce platforms (Shopee, Tokopedia Indonesia).

⏱️

Registration cycle

If successful, the entire registration process takes about 12-18 months, including key stages such as formal examination, substantive examination, announcement, and approval, making it one of the countries in Southeast Asia with the longest review cycles.

🌐

International alignment

Indonesia is a member of the Madrid System and can apply for international trademark protection through the Madrid Protocol, covering the Indonesian market without submitting a separate application to DGIP.

Trademark registration process

Indonesian trademark registration follows the Indonesian Trademark Law 2016 and the DGIP examination rules. The following are the standardized application steps

1. Trademark search

Searching the DGIP database to assess trademark registrability, avoid conflicts with prior trademarks, and reduce the risk of rejection, Indonesia adopted the 11th edition of the Nice Classification.

2. Submit the application

Prepare complete application materials, submit the registration application to DGIP, pay the official fee, and receive the application receipt and application number within 5-7 working days.

3. Formal review

DGIP reviews the completeness and standardization of application documents. If they do not meet requirements, corrections must be made within a specified period, which is generally two months.

4. Substantive Examination

The examination period for examining the distinctiveness, legality, and similarity of the trademark to the prior trademark takes about 6-8 months.

5. Announcement of objections

The trademark is published in the Indonesian official trademark gazette for three months. Any interested party may raise an opposition during this period, and if there is no objection, registration will be approved.

6. Issuance of certificates

After completing all examination procedures, DGIP issues a trademark registration certificate, officially taking effect with a validity period of 10 years.

Frequently Asked Questions

Answers to common questions about Indonesian trademark registration

Yes. Indonesian law stipulates that non-Indonesian residents or companies not registered in Indonesia must appoint a local Indonesian intellectual property agent to handle trademark registration. Local agents are familiar with DGIP examination rules and Indonesian language communication requirements, which can effectively improve the success rate of registration.
Yes. If a trademark application is rejected by the DGIP, the applicant can request a review within 30 days of receiving the rejection notice and submit relevant evidence and reasons. If the review is still rejected, an appeal can be filed with the Commercial Court.
Yes. Indonesian trademark law states that if a registered trademark is not used in Indonesia for three consecutive years, any interested party can file for its cancellation (cancellation for non-use). Therefore, after registration, the trademark should be actually used in Indonesia, and complete evidence of use (e.g., sales receipts, advertising materials, etc.) should be retained.
An Indonesian trademark is valid for 10 years. Renewal applications must be submitted within 12 months before expiration, with a grace period of 6 months after expiration (additional late fees apply). No evidence of use is required for renewal, only the submission of the renewal application and payment of official fees. After renewal, the validity period is extended by 10 years, and trademarks can be renewed indefinitely.
Yes. Indonesia allows the registration of Chinese trademarks, but a translation into Indonesian or English must be provided to clarify the meaning and pronunciation of the trademark. Purely graphical trademarks do not require translation, but the graphic must have distinctiveness and must not violate public order, morality, or religious regulations in Indonesia.
